  • "Services" refers to property curation, property viewing coordination, rental arrangement facilitation, and property management services provided by Azura.
  • "Agreement" refers to the property rental agreement executed between the client and property owner, facilitated by Azura.
  • "Website" refers to our online platform accessible at azuraol.pro and any associated subdomains.

2. Acceptance of Terms

By accessing or using our Website or Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, along with our Privacy Policy and Cookie Policy. If you do not agree to these terms, please discontinue use of our Website and Services immediately.

These Terms and Conditions constitute a legally binding agreement between you and Azura. Your continued use of our Services following any modifications to these terms constitutes acceptance of such changes.

3. Eligibility

Our Services are available only to individuals who are at least 18 years of age and possess the legal capacity to enter into binding contracts under Thai law. By using our Services, you represent and warrant that you meet these eligibility requirements.

If you are accessing our Services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms and Conditions.

Azura provides property curation and facilitation services for residential property rentals in Bangkok, Thailand. Our Services include:

  • Curated selection of residential properties based on architectural merit and design quality
  • Property information provision and viewing coordination
  • Facilitation of rental arrangements between clients and property owners
  • Property management services including maintenance coordination and guest support
  • Communication liaison between clients and property owners

Azura acts as an intermediary facilitating property arrangements. Property rental agreements are established directly between clients and property owners. Azura provides management services but does not own the properties presented.

5. Property Information and Availability

We strive to provide accurate and current information regarding properties in our collection. However, property details, availability, and pricing are subject to change without notice. We make reasonable efforts to update information promptly but cannot guarantee absolute accuracy at all times.

Property availability is confirmed through direct verification with property owners. Inquiries and expressions of interest do not constitute reservations until formal agreement execution and payment confirmation.

Property images and descriptions are provided for informational purposes and may not reflect every detail or current condition. We encourage property viewings to verify suitability for your requirements.

6. Rental Arrangements and Payments

6.1 Rental Agreement

Property rental arrangements require execution of a formal rental agreement between you and the property owner. This agreement will specify rental duration, payment terms, property rules, responsibilities, and other relevant conditions.

6.2 Pricing and Fees

Property rental rates are quoted in Thai Baht (฿) and represent nightly rates unless otherwise specified. Rates may vary based on rental duration, season, and property-specific factors. All applicable taxes, fees, and charges will be clearly communicated before agreement execution.

Service fees for our property curation and management services will be disclosed separately and agreed upon before arrangement confirmation.

6.3 Payment Terms

Payment terms, including deposit requirements, payment schedule, and accepted payment methods, will be specified in the rental agreement. Payments must be made according to agreed terms to maintain property reservation.

We utilize secure third-party payment processors for transaction handling. We do not store complete payment card information on our systems.

6.4 Cancellation and Refund Policy

Cancellation terms vary by property and rental duration. Specific cancellation policies will be outlined in the rental agreement before confirmation. Cancellations must be submitted in writing to [email protected].

Refund eligibility and amounts depend on the timing of cancellation relative to the scheduled occupancy period and the specific property's cancellation policy. Processing of approved refunds typically occurs within 14 business days.

7. Client Responsibilities

As a client utilizing our Services, you agree to:

  • Provide accurate, complete, and truthful information during inquiries and arrangement processes
  • Maintain the property in good condition and use it only for residential purposes
  • Comply with all property rules, building regulations, and Thai laws during occupancy
  • Report any property damage, maintenance issues, or concerns promptly to our management team
  • Respect neighboring properties and maintain appropriate noise levels
  • Ensure that the number of occupants does not exceed the agreed maximum capacity
  • Not sublease or allow unauthorized individuals to occupy the property
  • Allow property inspections and maintenance access with reasonable advance notice

8. Prohibited Activities

The following activities are strictly prohibited when using our Services or occupying properties:

  • Illegal activities of any kind, including drug use or storage of illegal substances
  • Activities that constitute nuisance or disturbance to neighbors or other residents
  • Modifications to property structure, fixtures, or furnishings without written permission
  • Commercial activities or business operations not explicitly authorized
  • Unauthorized parties, events, or gatherings exceeding reasonable occupancy
  • Smoking in non-smoking properties or areas
  • Keeping pets without prior written authorization
  • Misrepresentation of identity or provision of false information

Violation of these prohibitions may result in immediate termination of the rental arrangement without refund and potential legal action.

9. Intellectual Property

All content on our Website, including text, graphics, images, logos, property photographs, design elements, and software, is the property of Azura or our licensors and is protected by Thai and international copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use our Website for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works, publicly display, or otherwise exploit our content without express written permission.

Property photographs and descriptions are provided for informational purposes related to potential rental arrangements and may not be used for any other purpose without authorization.

10. Disclaimer of Warranties

Our Services and Website are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

While we make reasonable efforts to ensure property quality and service standards, we do not warrant that:

  • Properties will meet all your expectations or requirements in every aspect
  • Our Services will be uninterrupted, timely, secure, or error-free
  • Information provided will always be accurate, complete, or current
  • Defects in property or service delivery will always be corrected immediately

We are not responsible for property owner actions, third-party service providers, or circumstances beyond our reasonable control.

11. Limitation of Liability

To the maximum extent permitted by Thai law, Azura, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses resulting from:

  • Your access to or use of or inability to access or use our Services
  • Any conduct or content of third parties on or through our Services
  • Property conditions, maintenance issues, or owner actions
  • Unauthorized access, use, or alteration of your information

Our total liability for any claims arising from or related to these Terms or our Services shall not exceed the amount you paid to Azura in the six months preceding the event giving rise to liability.

12. Indemnification

You agree to indemnify, defend, and hold harmless Azura and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

  • Your use of our Services or violation of these Terms
  • Your violation of any law, regulation, or rights of third parties
  • Your occupancy of properties and any damage or loss caused to properties
  • Any false or misleading information you provide to us

13. Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or our Services shall be subject to the exclusive jurisdiction of the courts of Bangkok, Thailand.

Before initiating formal legal proceedings, parties agree to attempt good faith negotiation to resolve disputes. If negotiation does not resolve the matter within 30 days, either party may pursue available legal remedies.

14. Termination

We reserve the right to terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms.

Upon termination, your right to use our Services will cease immediately. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
